1. Introduction

Welcome to Vidofy AI, an AI-powered video generation platform (the “Service”), operated and owned by Youcha LLC. By accessing or using our website at https://vidofy.ai/ (the “Site”) or our mobile application, you agree to these Terms and Conditions (“Terms”). If you do not agree, you must stop using our Site and Service immediately.

If you take part in our Creator Program, additional terms apply to that participation — see the Creator Program Terms.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Service. If you represent an organization, you confirm that you have the authority to bind it to these Terms.

3. Account Registration

Some features require an account. You agree to provide accurate and updated information, secure your login credentials, and notify us immediately of any unauthorized activity on your account.

4. Use of the Service

Permitted Use: You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service in line with these Terms.

Prohibited Conduct: You must not:

  • Generate or share illegal, harmful, defamatory, obscene, or objectionable content.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use bots, scrapers, or automated tools to access the Site or Service.
  • Interfere with Service operations or connected networks.
  • Violate the intellectual property rights of others.

5. App Permissions & Updates

By installing the App, you consent to automatic updates and agree that certain device permissions (e.g., camera, microphone, push notifications) may be requested for full functionality. You may disable these permissions in your device settings, but some features may stop working.

6. User Content

Ownership: You retain ownership of the content you create or upload.

Commercial Use: You own the media you generate. What you may do with it depends on the plan you were on when you generated it:

  • Free: personal, non-commercial use.
  • Lite: personal use and your own social media channels, including channels you monetise.
  • Pro: full commercial use — marketing, advertising, and products or services you sell.
  • Ultra: everything in Pro, plus work delivered to clients (agency, freelance and white-label deliverables) and use across a team.

Rights you were granted for media you have already generated are not withdrawn if you later downgrade or cancel.

Storage: We keep the media you generate for a period set by your plan — 30 days on a free account, 60 days on Lite, and 365 days on Pro. On Ultra, media is not deleted automatically for as long as your Ultra subscription is active. Please download anything you wish to keep permanently; we are not a backup service.

If your subscription ends: nothing is deleted for 30 days. We will email you when your plan ends and again before that window closes, so you have time to download your work. After it closes, the standard period for accounts without an active subscription applies.

License: By submitting User Content, you grant us a worldwide, royalty-free license to use, modify, and display it for operating, improving, and promoting the Service.

Scope: “User Content” means content you create or upload on the Service. Content you publish on your own channels remains yours and is not User Content under this section, even where you submit a link to it — see the Creator Program Terms.

Content Restrictions: You may not submit content that:

  • Is false, misleading, or illegal.
  • Includes unauthorized face-swapping.
  • Violates copyrights, trademarks, or other IP rights.
  • Contains explicit sexual content or harmful material.
  • Contains malware, phishing, or malicious code.
  • Shares personal details without consent.

7. Intellectual Property

All rights to the Site, Service, and content provided by Vidofy AI are owned by us or our licensors. You may not use them without prior written consent. Feedback or suggestions you provide may be used by us without compensation.

8. Payment & Subscriptions

  • You agree to pay any applicable fees for premium features.
  • Payments may be processed through third-party providers.
  • All fees are non-refundable unless otherwise stated.
  • Payments we make to you — such as Creator Program rewards or affiliate commissions — are governed by the terms of the relevant program, including the Creator Program Terms.

9. Termination

By You: You may delete your account at any time.

By Us: We may suspend or terminate your account for violating these Terms.

Effect: All rights and licenses end immediately upon termination.

10. Disclaimers & Limitation of Liability

The Service is provided “as is” without warranties. We are not liable for indirect or consequential damages arising from your use of the Service.

11. Indemnification

You agree to defend and hold Vidofy AI harmless from any claims or damages related to your use of the Service or your violation of these Terms.

12. Changes to the Terms

We may update these Terms at any time. Updates take effect upon posting, and continued use of the Service means you accept the revised Terms.

13. Miscellaneous

  • These Terms, together with any program-specific terms you accept (including the Creator Program Terms), constitute the entire agreement between you and Youcha LLC, the operator of Vidofy AI.
  • If a provision is invalid, the rest remain enforceable.
  • Our failure to enforce a right is not a waiver.
  • You may not transfer your rights without consent; we may assign ours freely.
